• INDIVIDUAL CONSENT, RELEASE AND WAIVER FOR CWA REGATTA 2024

    You must fill out the information below and agree to the terms outlined in order to participate in this year's CWA Regatta.
  • Note: Triathlon teams are required to pre-register and each to fill out an individual waiver form. This event is limited to 20 teams; teams are limited to CWA members (at least 3 per team)and their guests (max one per team). Please consider obtaining a CWA membership. 

    NEW FOR 2024 

    Participants in Long Distance Canoe/Kayak, Sailboat Race and Long Distance Swim are also required to pre-register and fill out online waiver forms. 

     

  • Regatta Participants agree to the following terms:

    Participation and Recognition of Risks

    The Participant has inquired and is aware of all of the activities forming part of the Regatta to be held on August 3 and 4, 2024. The Participant gives permission for the Minor to participate in any and all aspects of the Regatta, recognizing that:

    1. there are inherent risks in participating in the Regatta;
    2. to the extent that there are specific Regatta activities in which the Participant does not want the Minor to participate, the Participant recognizes that it is their sole responsibility to ensure that the Minor does not participate in these activities, as you have assumed that, by the Participant's signing of this consent, release, and waiver, the Minor may participate in all of the Regatta activities;
    3. the Regatta is held on a volunteer and free basis, and no person directly or indirectly involved would so volunteer if they were to face any liability whatsoever and such persons owe no duty of care to the Participant or the Minor, including a duty of care pursuant to the Occupiers Liability Act, R.S.O. 1990, c.O.2;
    4. the Participant is the sole person responsible for the supervision and safety of the Minor; and
    5. As a condition of the Minor's participation in the Regatta, the Participant, acting in their role as parent or legal guardian of the Minor, must sign this waiver on the Minor's behalf.

    Waiver of Claim Against Parties for Damages However Caused

    The Participant, acting in their own legal capacity and/or in their legal capacity as parent or legal guardian, for and on behalf of the Minor, or the Minor's heirs, administrators or assigns, HEREBY RELEASE, WAIVE, AND FOREVER DISCHARGE AND SAVE HARMLESS and COVENANT NOT TO SUE the Cecebe Waterways Association and its officers, directors, members, agents, representatives (including any persons on whose property Regatta events are being held), servants, employees, and volunteers, together with the successors, heirs, executors, administrators, legal personal representatives, and assigns of the aforementioned, OF AND FROM ANY AND ALL CLAIMS, demands, damages, costs, expenses, actions, and causes of action, whether in law or equity, IN RESPECT OF DEATH, INJURY, LOSS, OR DAMAGE TO THE PARTICIPANT AND/OR THE MINOR OR THE PARTICIPANT AND/OR THE MINOR'S PROPERTY, HOWSOEVER AND WHERESOEVER CAUSED, arising or to arise by reason of the Participant's and/or the Minor's participation in any or all of the activities of the Regatta whether prior to, during, or subsequent to said participation AND NOTWITHSTANDING THAT ANY SUCH CLAIM MAY HAVE BEEN CAUSED, CONTRIBUTED TO, OR OCCASIONED BY THE NEGLIGENCE OF THE AFORESAID.

    Acknowledgment

    The Participant, in their own capacity and as parent or legal guardian of the Minor, has READ, UNDERSTOOD, and AGREED to this consent, release, and waiver. The Participant is authorized to sign this consent, release, and waiver on behalf of the Minor. This consent, release, and waiver shall be binding upon the Participant and/or the Minor and their heirs, executors, administrators, legal personal representatives, and assigns.
