This First/Second Shooter Agreement (from now on, we'll refer to this as the “Agreement”) is entered into as of the aforementioned date of this agreement (referred to now as “Effective Date”) by and between De La Vie, (referred to as "First Shooter") and as the contract for hire, (referred to "Second Shooter" and together with First Shooter, “the Parties”).
Second Shooter acknowledges and agrees that he/she is able to perform, and shall perform for First Shooter, services in connection with First Shooter's wedding and event photography business;
First Shooter wishes to retain Second Shooter to provide services, subject to the terms and conditions listed here;
The Parties do hereby agree to the following terms and conditions:
First Shooter shall compensate Second Shooter for the Services at the rates discussed and agreed upon.
Unless provided otherwise in a Statement of Work, Second Shooter shall be paid for each event (referred to as "Event") at the end of services performed.
No Reimbursement of Expenses
Second Shooter shall be responsible for expenses incurred in performance of Services, including, but not limited to, travel expenses, toll road fees, parking fees, meals, equipment costs, rental fees and repair costs. Unless otherwise discussed and agreed upon.
No Guarantee of Work
This Agreement is not a guarantee of work by First Shooter to Second Shooter. This Agreement shall only state the Services to be provided by Second Shooter as requested by First Shooter.
Independent Contractor Status
Second Shooter is an “Independent Contractor” and not an employee of First Shooter.
The Second Shooter must provide a TWO (2) weeks notice of any cancellation to services as discussed.
The Second Shooter is required to provided his/her own equipment, including proper maintenance, batteries, storage media cards and lighting. All glass must be adequately cleaned, batteries fully charged, and the Contractors camera to be properly synced to current time to ensure accurate chronological order of images on import. De La Vie requires SRAW files. It is a requirement of the Independent contractor to ensure this is completed before shooting.
Copyright + Reproduction Rights
The Independent Contractors assignment is a work-for-hire job; as such the copyrights to the images belong to De La Vie. With some exception, the Independent Contractor may use only THEIR images on social media, however some restrictions apply:
Second Shooter must NEVER post any sneaks or galleries before De La Vie
Second Shooter must mention they were a work-for-hire, meaning they shall never pass the wedding off as their own booking.
De La Vie must be mentioned in any post made to social media on a website, blog or other as being the primary hire for the wedding or event.
De La Vie reserves the right to deny release of any image as it may relate to the wishes + agreement with of the clients.
Etiquette + Attire
The Second Shooter understands that as a work-for-hire they are a direct representative of De La Vie and must conduct themselves as such. It is the expectation as a work-for-hire of De La Vie that the Second Shooter:
Arrive on site, early + prepared
Is dressed professionally in business casual attire that is free of rips, stains, holes + ill-fitted clothing. Dark clothes and NO WHITE OR CREAM.
Limits their use of visible phone use outside of communication as needed
Refrains from the use of profanity, gum chewing and alcohol consumption
Has reliable transportation that has the proper amount of gas to stay on schedule
The Second Shooter understands that as a work-for-hire it is strictly prohibited that there be any advertisement whatsoever or self-promotion of his/her own business. As a work-for-hire, the only business cards or information to be handed out or discussed is the matter of De La Vie. Any following communication on images will be direct through De La Vie.
De La Vie is not responsible for any loss, damaged or stolen items or equipment of the Second Shooter under this contract by unforeseen accident or instances.
