Supra Products are sold only through authorized Supra locations to ensure the image and quality of the brand. As an authorized Supra dealer, Dealer agrees to the following standards:
1. A minimum opening order of $2500 will be placed for each location. An acceptable presentation of product must be maintained at all times.
2. Supra products must be consistently advertised with the material supplied from Supra. Advertising materials can be obtained through the Supra Marketing Department. The Director of Marketing must approve all Supra product lines that are advertised prior to print.
3. The above Supra lines will be sold only through the locations listed above.
4. Dealer agrees not to sell or display any imitation Supra products.
5. Dealer agrees that when new locations are being negotiated, Supra is informed within a reasonable time frame. New dealership applications must be filled out and approved by Supra’s Sales Manager for all new locations. Products can not be displayed in these locations until they have been approved by Supra.
6. Dealer agrees that Supra displays are the property of Supra. Supra reserves the right at any time to update the presentation. Dealer agrees not to display any other products in Supra displays.
7. Dealer agrees that Supra shall have a 90 day period from the date of receiving signed Retail Sale Agreement wherein Supra shall be given the right to inspect the Retailer’s premises and review the Dealer’s selling practices. If Supra determines that Dealer does not meet the standards set forth in the Retail Sales Agreement, then Supra shall have the right to terminate this agreement.
8. Dealer agrees that failure to abide by Retail Sales Agreement may result in termination of delivery of goods by Supra and the liability for damages. Dealer agrees that the prevailing party in any litigation concerning this agreement or the breech thereof shall be entitled to reasonable fees and costs.
